I hereby Request An Administration Hearing re citation AC-7782
Dear: Laguna Beach Police Department,
Declaration in Support of Dismissal
I Derrick Michael Reid, do hereby declare and state:
1) I was cited for LBMC 10.02.020(B) skate board riding on walkways, and purportedly refused to stop my 3 year old sons from riding on main street Beach.
2) I don’t believe I am guilty because, I was not riding anything, and a citation against me is unfounded, as the real alleged perpetrators were two toddlers, who were not cited.
3) I don’t believe I am guilty because, the 3 and 4 year old toddlers of mine were not on a "skakeboard" understood to be a platform on four wheels, but rather were in possession of 3-wheeled scooters having handle bars connected to a vertical steering column connected to one front wheel for steering, with two back wheels.
4) I don’t believe I am guilty because, the 3 and 4 year old toddlers of mine were not "riding" anything, but were rather pushing with one foot on the ground while the other foot was on the scooter, like having one knee in a little red wagon, and the other leg outside pushing, having a MAXIMUM SPEED OF 5 miles per hour.
5) I don’t believe I am guilty because, the 3 and 4 year old toddlers presented no reasonable risk of bodily harm or property damage to anyone, and the application of the law against them is against PUBLIC POLICY, and inherently unreasonable, as, F=MV2 the force impact by a 30pound toddler moving at 5mph is 30(52) or a force of 750#m2/hr2, which simply is insufficient to reasonably cause damage to anyone or anything.
6) For over one hour I remained in the center of Main Beach, and observed eigth different young males, about high-school age, about 125 pounds in body weight, RIDE (with both feet on the flatforms) their SKATEBOARDS, at a speed of at least 20mph, providing an F=MV2 of 125(202)=50,000#m2/hr2, which is sufficient to reasonably cause damage to persons or even property.
7) It was obvious to me and I believe would have been obvious to anyone, that the code in question was selectively enforced by the LBPD against me, in violiation of my civil rights.

9) It was obvious to me and I believe would have been obvious to anyone, that the code in question was selectively enforced by the LBPD against me, and not the high-schoolers, because a Lieutenant Life-Guard did not like my boys around the lifeguard building or the lifeguard cars, both of which are positions by or on sidewalks on mainbeach, and this Lieutenant apparently called the police.
10) Within 15 minutes, a non-police city-officer issued the citation, who was backed up with a female sargent, the apparent watch commander, and another officer named John, who all collectively and apparently tried to shut me up, and took exception to my excerise of my free speech rights, in violation of my civil rights.
11) I have lived and own property in Laguna beach for 20 years, have enjoy taking my two little boys to the beach often, in the very late afternoons for ice cream, scooter rides and play at the beach, and have never heard one complaint from anyone, except the Lieutenant Lifeguard.
I declare under penalty of perjury the forgoing is true and correct under the law of the state of california, this declaration being executed June 19 2008, in the city of Laguna Beach.

Have you people lost your freaking minds? Don’t you people understand the concept of prosecutory discretion? I can understand that the Lieutenant lifeguard may not like little kids near "his" lifeguard official public vehicles or near "his" HQ public building, but, when you place such right there on main beach, in pedestrian walkways, what else do you expect? Little kids are little kids, and are not monotones that are subject to absolute control-freak lieutenants or their supporting police buddies, and I am not one to simply walk away from an absured and vindictive prosecution for the harmless acts of three year olds.
If you request, my implication through a lack of dismissal of the citation, I am more that willing to make another one of my huge campaign signs, and parade up and down main beach, ALL SUMMER LONG, on a daily basis, about 2 hours each day, handing out flyers, making loud speeches so that everyone can hear my important political messages, which might be delivered in perhaps not such flattering langauage as you all would deem desirable, explaining to the public, the GESTOPPO LIKE NAZI GUARD DOG MO of laguna beach "public servants".
On the other hand, by dismissal, by implication, mutual apologies are exchanged, and I will keep my toddlers away from the Lieutenant's HQ and his precious vehicles.

A copy of the citation is provide herewith. I hereby submit the question based upon the foregoing, and waive rights to be personally present at the hearing, unless requested to attend the hearing, which I would do, if more information is desirable. Please find herewith a check for the fine of $100.00 which I hope will be returned to me in due course, as justice requires it.

Laguna Beach is so into its rump ranging liberalism, that they are going control the minions to their line of thinking, to enact countless petty laws, rules, and ordinances so the city bosses can pound their chest thinking they are doing the public good, controlling all our lives, in minutia, while high-school boys wear makeup and ear-rings school, their faces looking like a tackle-box, and girls betting who can hook-up first at the beer party, its their right you know.
In the case at point, the infamous 3 year old scooter ride, the lieutenant could have simply asked me to do what he wanted me to do in the form of a request, to curb the boys riding their scooters near the life guard HQ and cars, or whatever, but he did more than that, he threatened me with criminal prosecution, if I not hop to. The cop on the beat should use the citation book as a means of last resort to prefect the desired result, not to get brownie buttons and fill the city coffers, but TALK to people, and encourage desired behavior, civilly. But, that is not what occurred. There was no polite request from the city servant, that would have been complied with, but a threat of criminal prosecution, if I did not jump to. I was threatened with criminal citation for the relatively harmless acts of two little boys on scooters. Talk about a power trip, but I guess, that is what the city bosses are all about. Less of government is more freedom. Less is more.
I use to not understand these armed militias and the mountain recluses, thinking they were whacked out, resorting to shooting officers who get to close to the cabin and blowing up buildings in despair, but the more I understand government, the liberal agenda of control control control freak mentality, and the Laguna Beach City bosses are exemplar, for what it is, and what they are, the more I understand the mountain lunacy, and the evils of city hall. The reasons we have the rights to guns, is not only to self protect persons and property, but to take down dictatorial governments, and lets not forget, we once fought for freedom, but nowadays, we bow down to the city bosses, a pervasive learned culture of weak minds from decades of the selective controlling liberalism at city hall.
I am tired of taking it in the rears, I aint a liberal rumpranger.

Case Dismissed
The authorities, federal, state, and local all try to control the minions with laws enumerable and enforced by the police state. The FED does it to us all using FIAT, instead of the using constituional real money coinage, our freedoms being denied. Midas does his thing on the big board, but we all should do our part, no matter how small, to stop every unreasonable encroachment upon our liberties.

Thank you posting my declaration in support of dismissal of LBMC citation for riding skateboards on main beach by my 3 and 4 year old boys, when in fact, they were riding only scooters, as an apparent vindictive use of the citation book. I am pleased to report that the citation was dismissed by a city administrator. Justice was served. Mistakes can be made at times, but do rest assured, in my 20 years of living in Laguna Beach and 30 years earlier throughout the great State of California, the LBPD is one of the finest, if not THE FINEST, police departments in whole state.
I do not know the name of the administrator, who dismissed the citation on the narrow grounds, "it was not a skateboard, and I am dismissing the citation for that only reason", as she of course would not address nor admit any other wrong doing by the LBPD, such as, vindictive prosecution and violation of free speech civil rights. She was a heavy elderly woman, with short sandy hair, and honesty, was very commanding, with a strong presence, as she knows very well how to handle herself, especially hot-heads like me, and I was actually very impressed, as she is the right gal for the right job. The city is well served with this woman at her post.
What was really so so funny, at the administrative hearing, though, were the two clerks watching from the left in an elevated desk position, one, the brunette, was lively and nice and smiled, but that pretty one, with blond hair, 30ish, just gave me the evil eye the whole time, like "how dare you" accuse the city of wrong doing. I speculated in my mind that she was either a city attorney looking out for a possible federal law suit, or a criminal psychologist trying to determine if I was likely to blow-up city hall. So funny to me, actually, the three gals were so completely different in demeanor.
Anyway, I have no intent in taking this any further, though I believe I could tag the city for a quarter million in a federal court, if I choose to do so. But why? Why turn a mistake into a lotto game for personal greed? What is achieved here is that the dismissal served justice and was in effect a public recognition of a wrong. If an officer has a problem, I would encourage the officer to talk to people, and kindly request desired behavior, rather than resorting to the citation book and threats of prosecution as the first means of promoting law and order.
Please clearly understand, that the civilian-police officer, just continued to smile, with a wide grin, at me in contempt and petulance, that irked me to no end, as he wrote the citation, giving me the impression that he knew he would, using the citation book, effectively force me to fight city hall, and loose my time and income, in so doing, and consequently, even if the citation was a bogus one, he was going to cause me pain for not obeying his direct command to curb the four year child, and that he would win the skirmish. I did curb the three year old, taking the scooter away from him, but that child broke out into crying throwing himself down on the boardwalk with 30 people wondering what was wrong. It was a pathetic scene. Now, do I tell the 4 year old the same thing, "the police said you cant ride your scooter", and take it from him, in compliance with police maliciousness? Well, I told many people on main beach in my impromptu loud and vulgar speeches what I thought of his actions, right then and there. The sergent on duty, and on the sceen, and over seeing the citation issuance, did nothing, and allowed the civilian-police officer to write a bogus citation for riding a skateboard, with the scooter right there in plain vew.
Your posting of my declaration, served to provide a necessary negative feedback to the police department to keep the officers in line from this kind of oppressive conduct by the police department. Revenge is a sweet delicious dish, best served ice cold. Thank you again for posting my declaration, as it serves the community in maintaining a good police force, and provides negative feedback to encourage proper police enforcement to maintain a good police department, and LBPD is certainly one of the best.
